The Investigation Must Account for How the Person Communicates
Autism does not determine what happened in a criminal or school matter. It can, however, affect communication, interpretation of social cues, sensory response, recall under pressure and how a person's behavior is perceived by police, witnesses, teachers or jurors.
An autism-informed investigation examines those circumstances without treating a diagnosis as an explanation for every action.
How We Support Counsel and Families
- review reports, recordings and witness accounts for communication or sensory context that may have been overlooked;
- plan interviews around the individual's communication needs rather than forcing a standard format;
- document developmental, educational and service history relevant to mitigation;
- identify records and first-hand witnesses who can establish functioning before the incident; and
- coordinate with qualified clinical or educational experts when an opinion falls outside the investigator's role.
Autism, Evidence and Legal Strategy
Autism is not automatically a defense to a criminal allegation. Its relevance depends on the facts, the legal issues and qualified advice from counsel. An investigator develops the factual record; an attorney determines how that record may be used.
If charges are pending, speak with a criminal defense attorney promptly. Counsel can also request appropriate accommodations and determine whether expert evaluation is necessary.
A More Careful Interview Is Better Evidence
Leading questions, rapid repetition and pressure can distort any interview. The risk is greater when the interviewer mistakes delayed processing, atypical eye contact or literal language for dishonesty. Our approach slows the process down, records the conditions and avoids claiming more certainty than the response supports.
